In A Relationship With A New Zealand Citizen?
The New Zealand Citizen Family Relationship subclass 461 visa is a five year temporary visa that allows someone who is not a New Zealand citizen to live in Australia with a family member who is a New Zealand citizen who either holds or is eligible to hold a Special Category subclass 444 visa.
The Special Category subclass 444 visa allows New Zealand citizens who arrived in Australia after 26 February 2001 to live and work in Australia indefinitely, so long as they remain New Zealand citizens.
This is a great visa for the de facto partners or spouse of a New Zealand citizen to live and work in Australia while they remain in a de facto relationship with their New Zealand partner. You can be in or outside Australia when you apply for this visa.
What if my Partner is an Eligible New Zealand Citizen?
Eligible New Zealand Citizens are New Zealand Citizens who were living in Australia on 26 February 2001 or lived in Australia for at least one year in the two years immediately before 26 February.
They have the same rights and benefits as Australian citizens or permanent residents. If you are married to or in a long term de facto relationship with an Eligible New Zealand Citizen you should meet the criteria for an Australian Partner visa.
What does the New Zealand Family Relationship subclass 461 visa allow me to do?
Applicants will qualify for this visa if:

- They are not a New Zealand citizen (New Zealand citizens qualify for the Special Category 444 visa)
- They are an eligible family member of a New Zealand citizen
- Their New Zealand citizen family member is living in Australia on a subclass 444 visa or will be traveling with the applicant to Australia and will be granted a subclass 444 visa on arrival.
- Applicants are related to the New Zealand citizen as either:
- their spouse or de facto partner
- their (or their partner’s) dependent child
- the dependent child of their (or their partner’s) dependent child
- their (or their partner’s) relative who:
does not have a partner
usually, lives in the New Zealand citizen’s household
is dependent on the New Zealand citizen.

Relationship evidence for a New Zealand Citizen Family Relationship subclass 461 visa
Applicants must provide proof that they have been living in a de facto relationship with their new Zealand partner for at least six months.
On its own, registering a relationship is not acceptable proof of a de facto relationship for the purposes of a subclass 461 New Zealand Citizen Family Relationship visa.
Additional evidence such as:
- joint leases;
- joint bank accounts;
- joint bills;
- email to the same address;
- receipts for holidays together;
– and/or other evidence of the relationship will be required.
